Riverside, California – Two students from Martin Luther King High School are in the news after filing a lawsuit against their school district. They claim their First and Fourteenth Amendment rights, as well as protections under Title IX, were violated due to the school’s response to their choice of clothing.
The students, Kaitlyn and Taylor, wore T-shirts that read “Save Girls’ Sports” and “It’s Common Sense. XX ≠ XY.” Their intention was to express their concerns after a transgender athlete who had not met certain participation requirements took Taylor’s place on the varsity cross-country team. Taylor expressed her surprise and disappointment, saying, “I was really surprised, because it was like, why is this happening to me?”
According to the lawsuit, school officials asked the girls to remove or hide their T-shirts, claiming the messages created a “hostile” environment. The officials even compared wearing the shirts to wearing a swastika.
Kaitlyn explained, “It was definitely hard to hear because we’re by no means trying to be hateful. We’re just wearing a shirt that expresses what we believe in trying to raise awareness to a situation.” The girls point out that their transgender teammate has been allowed to display “trans pride” messages without facing similar consequences.
The complaint also mentioned that Taylor’s placement on the junior varsity team could hurt her chances with college scouts, as it was a crucial time for recruitment. The girls’ attorney, Julianne Fleischer, stated the lawsuit is aimed at addressing violations of their rights and ensuring all students have the freedom to express their viewpoints.
In their complaint, the students expressed feelings of being overlooked despite their commitment to the sport, emphasizing the need for clarity from the school about selection criteria for teams. As more students start raising their voices about similar issues, the outcome of this lawsuit may have implications beyond just their case.
The Riverside Unified School District has not yet provided any comments regarding the lawsuit. The case arises at a time when the rights surrounding gender identity and sports remain a hotly debated topic across the country.
